Private transfer taxes are similar to the real estate transfer tax, except that it is a private party that collects the fee upon every single sale of a particular home, rather than a governmental entity.
At its most basic elements, the imposition of private transfer fee allows a third party to collect a fee upon every purchase of a particular property, calculated as a percentage of the sale price far into the future. While the legality and enforceability of this approach is the topic of much debate, South Carolina REALTORS® are seeking to proactively protect South Carolina consumers through legislation prohibiting the imposition of new private transfer taxes or fees. Five states (TX, MO, FL, OR, and CA) have already passed bills into law that prohibit private transfer fees, and several other states have pending legislation. Improving professionalism in the real estate industry remains a priority for South Carolina REALTORS®. Over the past year, we have been working with the House Labor, Commerce and Industry Committee and their staff on an update of the Real Estate Practice Act.
South Carolina REALTORS® are proposing an update to the Real Estate Practice Act to modernize the license and the Real Estate Commission. SCR is proposing an increase in both the quality and quantity of pre- and post-licensing education available to real estate professionals across the state, modernizing the current three license categories into one-single broker license, and modernizing the SC Real Estate Commission and the way it interacts with licensees and consumers. The proposal would increase accreditation requirements for education providers and instructors, expand the course offerings and delivery methods, and build on mentoring currently available in the industry for new real estate professionals. We expect this bill to be introduced the first day of session by House Labor, Commerce and Industry Committee Chairman Bill Sandifer (Oconee).

SECTION 40-57-100. Educational requirements conditional to application for licensure.
(A) As a condition for and before applying to take a license examination, an applicant for a salesman, broker, or property manager license shall provide proof of having met these educational requirements within the last five years:

(1) For a salesman's license, completion of sixty hours of classroom instruction in fundamentals of real estate principles and practices or evidence submitted to the department of a Juris Doctor, Bachelor of Laws degree, or a baccalaureate degree with a major in real estate from an accredited college or university. Within one year following licensure, a salesman shall provide proof of satisfactory completion of thirty hours of post-licensing instruction in advanced real estate principles and practices. Failure to complete the post-licensing education within one year will result in cancellation of the license;

(2) For a broker's license, completion of one hundred fifty hours, ninety hours of which may be the hours required for a salesman's license, of classroom instruction in advanced real estate principles and practices and related topics, and three years of experience with a salesman's license or evidence submitted to the department of a Juris Doctor, Bachelor of Laws degree, or a baccalaureate degree with a major in real estate from an accredited college or university or the commission may accept proof of related education and at least five years of experience immediately preceding license application in business activities equivalent to or closely related to real estate transactions;

(3) For a property manager's license, completion of thirty hours of classroom instruction in property management principles and practices or evidence submitted to the department of a Juris Doctor, Bachelor of Laws degree, or a baccalaureate degree with a major in real estate from an accredited college or university.

(B) As a condition of licensure, an applicant shall submit to an examination which must be conducted by the department or a designated test provider at a time and place specified by the department.

The applicant must receive a passing grade on the examination, in accordance with a cut-score determination established by the department.

An applicant who fails an examination may be reexamined within the six-month period following initial examination. If an applicant passes one part of a two-part examination and fails the other, the applicant may be reexamined on the failed portion within the succeeding six-month period.

An applicant who passes the examination must apply for a license within one year, or the applicant must reapply for and retake the examination.

An individual who, at the time of application, holds a real estate license in another state or jurisdiction or whose real estate license in another state or jurisdiction expired not more than six months before application is required to pass only the state portion of the examination to qualify for licensure.

The department or test provider is authorized to collect and retain reasonable examination fees. An applicant for an examination to be conducted by a test provider shall pay the fee directly to the test provider.

Question: Existing homeowner credit: Must the new house cost more than the old house?
Answer: No. Thus, for example, individuals who move from a high cost area to a lower cost area who
meet all eligibility requirements will qualify for the $6500 credit.
Question: I am an existing homeowner. On October 25, 2009, I signed a contract to purchase a
new home. I have lived in my current home for more than 5 consecutive years and
am within the new income limits. I will go to settlement on November 20. If
President Obama has signed the bill by the time I go to settlement, will I qualify for
the new $6500 tax credit?
Answer: Yes. The existing homeowner credit goes into effect for purchases after the date of enactment
(when the bill is signed). There is no reference to the date of contract for the new credit. The
provision looks solely to the date of purchase, which is generally the date of settlement.
Question: I am a firsttime
homebuyer but was not within the prior income limits at the time I
entered into my contract to purchase on October 30, 2009. I will be covered,
however, by the new income limits. If the new rules have been signed into law by the
time I go to settlement, will I be eligible for a credit?
Answer: Yes. The new income limitations go into effect as soon as the President has signed the bill.
The income limit and other eligibility rules will look to your status as of the date of purchase,
which is the settlement date. So if the new rules have been signed when you go to settlement,
you should be eligible for the credit (or a portion of the credit if you're within the phaseout
range).
Question: I am an eligible existing homeowner. I have a fair amount of equity in my home. I
have found a home with a nonnegotiable
price of $825,000. Will I be able to use any
of the $6500 tax credit?
Answer: No. The $800,000 cap on the cost of the purchased home is firm at $800,000. Any amount
above $800,000 makes the home ineligible for any portion of the credit. The $800,000 is an
absolute ceiling.
Question: I owned my home for 10 years, but sold it two years ago year and have been renting
since. If I purchase a home, will I be eligible for the $6500 tax credit if I meet all the
other eligibility tests?
Answer: Yes. Because you lived in the home for more than 5 consecutive years of the previous 8, you
will qualify for the $6500 credit. For example, Say John and his wife bought a home in 2000
and lived there until 2008 when he got a divorce. Whether John has been renting or bought in
the interim, he WOULD INDEED be eligible for the credit because he owned a home and
occupied it as his principal residence for 5 consecutive years out of the last 8 years. The
keyword here is "consecutive." As long as he lived in that house for 5 years straight what he
did since 3 years doesn't impact eligibility.
Question: I am an eligible firsttime
homebuyer. I entered into a contract to purchase on
November 1, 2009. Do I have to go to closing before December 1? How does the
extension date affect me?
Answer: You do not have to close before December 1. Once the legislation has been signed, it will be as
if the Nov 30 date had never existed. Therefore, so long as the contract settles before April 30
(or July 1, worst case), the purchaser will be eligible for the credit.

$8,000 tax credit extended through April, 2010

The House of Representatives passed legislation to extend and expand the current first-time homebuyer tax credit. The House action follows the Senate's approval and we anticipate President Obama will sign the bill in very short order.

The bill extends the current $8,000 first time homebuyer tax credit through April, 2010. It also includes a tax credit of up to $6,500 for qualified move up buyers and increases the borrower income limits for both credits to $125,000 for individuals and $225,000 for couples.

Homebuyers will qualify for the full credit as long as they have entered a binding contract by April 30, 2010 and they close the transaction by June 30, 2009. The tax credit is limited to homes with a purchase price of $800,000 and below.

In addition, the legislation waives the recapture provision for members of the armed forces who are called on extended duty. These members of our military and uniformed services, who are out of the country for at least 90 days, will also be eligible to use the tax credit upon their return through April 30, 2011.

There has been a lot of questions from realtors asking if a first time homebuyer can use the $8,000 tax credit as a down payment. That program has only been approved for a few other states. Here is the response I received from our Regional Emerging Markets Director who handles low to moderate income programs:

Our participation is based on the South Carolina State Housing Agency participating in the program. Currently, they have indicated that they will NOT participate. We are only allowing the participation if the local state bond agencies will monetize the tax credit. It's up to SC Housing to change their minds regarding participation.

On February 24, 2009, Fannie Mae sent Announcement 09-03 to its servicers instructing them not to negotiate commissions on short sales below the amount negotiated by the listing agent, unless the commission exceeds 6 percent. The Announcement reminded servicers that third party approvals (i.e., private mortgage insurers) may be required and can affect commissions. In response to concerns raised by NAR that some servicers of Fannie Mae loans are unaware of this policy or believe it is not binding, Fannie Mae has established a process for NAR members when short sale commission issues arise.

The "Protecting Tenants in Foreclosure Act," became law on May 20. The law will:
• Give all renters in properties that are foreclosed after May 20 at least 90 days notice before having to move. In most cases, tenants will be allowed to reside in the home through the end of the lease term.

• Give tenants with section 8 vouchers the same rights to remain as other tenants. The new owner at foreclosure (typically the mortgage lender) will automatically become a party to the Section 8 contract, enabling families to retain their rental assistance and to continue to afford their housing.

The Federal Reserve announced a $1.2 trillion plan three months ago designed to push down mortgage rates and breathe life into the housing market.

But this and other big government spending programs are turning out to have the opposite effect. Rates for mortgages and U.S. Treasury debt are now marching higher as nervous bond investors fret about a resurgence of inflation.

That's the Catch-22 threatening to make an awful housing market potentially worse and keep the economy stuck in a funk. Kick-starting the economy requires higher spending, but rising rates mean fewer Americans will be able to refinance their home loans. And some potential buyers will be shut out of the market by higher monthly payments they won't be able to afford.

To understand how this is all connected, you have to think like a bond trader. Inflation is their enemy because it means the purchasing power of the dollars they receive when bonds eventually are paid off will be diminished. The only question is by how much.

Yields on 10-year Treasury notes, a benchmark for home mortgages and other consumers loans, jumped from 2.5 percent in March around the time of the Fed announcement to as high as 3.7 percent in recent days as signs that efforts to stabilize the financial system and economy were starting to pay off. And 30-year mortgage rates jumped more than a quarter-point this week to 5.29 percent, the highest level since December, Freddie Mac reported.

"If the meltdown continues in the bond market, then mortgage yields will soon be at levels that choke off refinancing activity," said economist Ed Yardeni, who runs his own investment firm. "Even worse, they could abort any necessary recovery in home sales and prices."

Yardeni coined the term "bond vigilantes" in 1983 to describe how traders took matters into their own hands when they felt the Fed wasn't doing enough to fight inflation, which was running at an annual rate of more than 3 percent at that time.

So what has set off the vigilantes this spring, at a time when the consumer price index is down at an annual rate of 0.7 percent?

One explanation is that bond investors anticipate a greater supply of government debt being sold to fund federal spending. Investors are also increasingly fearful that the trillions of dollars the government will need to borrow in the coming years to finance the various stimulus programs will lead to a new bout of inflation.

The White House estimates that the government will rack up an unprecedented $1.8 trillion budget deficit this year -- more than four times last year's all-time high.

"The bond market is calling the Federal Reserve out," said Mike Larson, a real estate analyst at Weiss Research Inc. in Jupiter, Fla. "Investors are saying that the Fed can't just print money out of thin air to finance a massive deficit."

Fed Chairman Ben Bernanke acknowledged Wednesday in congressional testimony that large budget deficits could threaten financial stability by eventually eroding investor confidence and endangering the economy's prospects for long-term health.

"Even as we take steps to address the recession and threats to financial stability, maintaining the confidence of the financial markets requires that we, as a nation, begin planning now for the restoration of fiscal balance," Bernanke told the House Budget Committee.

That kind of talk is meant to calm bond investors' nerves. It also shows the quandary faced by Bernanke and other federal officials. They need to hold down interest rates through massive government spending at the same time they have to deal with worries over how that spending could damage the economy over the long term.

After Fed policymakers this spring said they would buy billions of dollars of government debt and more than $1 trillion of mortgage securities, 30-year fixed mortgage rates fell to 4.78 percent in April, the lowest since Freddie Mac started surveying rates in 1971.

Sales of new and existing homes began to trend higher. Mortgage refinancings also jumped, allowing borrowers to lock in lower rates. Fee income from this activity helped lift profits at many battered banks and gave consumers more disposable income to spend, which helped lift their confidence about the economy's prospects. All that was good for the nation's businesses.

But now, surging mortgage rates are threatening to undermine all that. Seventy percent of refinancing activity could be knocked out as rates close in on 5.5 percent, according to Mark Hanson, a managing director at the independent research firm Field Check Group of Menlo Park, Calif.

That's because homeowners wouldn't get much of a benefit if a refinancing only reduces monthly payments a tiny bit while they are stuck paying closing costs that typically run about 2 percent of the loan amount.

Also, many homeowners who wanted to refinance didn't lock in the super-low rates in April when the refi boom took off. "Half the deals in the pipeline are dead," Hanson said. "People were applying to refinance to improve their situation, but now they are seeing it won't be much improved."

All this means that even though mortgage rates are still low by historical standards, many of the trends that seem to be pointing to economic recovery in recent months could be undone fast.

Bills Introduced to Extend, Expand Homebuyer Tax Credit
Several House members have introduced bills reflecting their support for the homebuyer tax credit and urging that it be expanded and extended. NAR is saluting their efforts, but has not endorsed any particular approach. The bills have differing details, but, taken together, all would have beneficial effects on the housing market. NAR anticipates additional bills in the near future. The bills introduced so far:
• H.R. 2562: Ron Kind (D-WI) and 3 bipartisan cosponsors. The bill extends the tax credit through December 1, 2010, but limits the extension to individuals who served for 3 months or more in the military during 2009.
• H.R. 2606: Eddie Bernice Johnson (D-TX). The bill expands the credit to all purchasers, not just first-time purchasers. The bill extends the credit through December 31, 2010. Her bill also eliminates the repayment feature that applies to the $7500 2008 tax credit.
• H.R. 2619: Kenny Marchant (R-TX). The bill makes the credit available to all purchasers and also extends the credit through June 30, 2010. The bill also provides a temporary $3000 tax credit that has the effect of refunding the closing costs associated with refinancing a mortgage, so long as the refinanced amount was no greater than the outstanding balance on the mortgage being refinanced.

HUD Announces Guidance for Use of Tax Credit on FHA Loans
In his speech at the National Association of REALTORS® Housing Summit on May 12, 2009, US Department of Housing and Urban Development (HUD) Secretary Shaun Donovan announced a program that allows borrowers to use the first-time homebuyer tax credit for a down payment or closing costs on a FHA-insured mortgage. The Secretary said "We think the policy is a real win for everyone, ensuring that borrowers can tap into the numerous organizations that are already part of the FHA network to receive this additional benefit."

The details of the program were announced today in Mortgagee Letter 2009-15. Government entities and instrumentalities of government may provide a second mortgage. Currently, 10 state housing finance agencies offer a product buyers can use that will effectively monetize the tax credit for down payment purposes. These states are Colorado, Delaware, Idaho, Kentucky, Missouri, New Jersey, New Mexico, Ohio, Pennsylvania, and Tennessee. State Associations are encouraged to work with their respective housing finance agency to implement similar programs. The 3.5 percent down payment may also be a gift from a family member, employer or nonprofit, charitable organization.

The original guidance permitted lenders and HUD-approved nonprofits and lenders to offer bridge loans via second lien financing or short term loans. Guidance released today allows lenders to offer the monetized tax credit for down payments in excess of 3.5 percent, closing costs and interest rate buy downs. Mortgage industry leaders have indicated that this type of product may not be immediately available to consumers. Lenders will need some time to develop documentation for what will effectively be personal loans to the home buyer.

The 26 U.S. cities with the worst foreclosure problems are concentrated in four states — California, Florida, Arizona and Nevada, a report released Wednesday shows.

The report on foreclosures for the first quarter by RealtyTrac Inc. said the highest foreclosure rates were found in Las Vegas, Merced, Calif. and the Cape Coral-Fort Myers area in Florida. Next on the list were the California metro areas of Stockton, Riverside, Modesto, Bakersfield and Vallejo-Fairfield.

Rounding out the top 10 were Phoenix and Port St. Lucie, Fla. Outside of the four high-foreclosure states, the worst foreclosure rates were in Boise City, Idaho (No. 27) and Greeley, Colo. (No. 29).

The number of American households threatened with losing their homes grew 24 percent in the first three months of this year and is poised to rise further as major lenders restart foreclosures after a temporary break.

Nationwide, nearly 804,000 homes received at least one foreclosure-related notice from January through March, up from about 650,000 in the same period a year earlier, RealtyTrac said last week.

The big unknown for the coming months is President Barack Obama's plan to help up to 9 million borrowers avoid foreclosure through refinanced mortgages or modified loans.

The Obama administration expects it to make a big dent in the foreclosure crisis. But it remains to be seen whether the lending industry will fully embrace the efforts, despite a promise of $75 billion in incentive payments.

Pulte Homes , Centex Corp

Pulte Homes (PHM.N), the fourth-largest U.S. homebuilder, said it would buy the third largest, Centex Corp (CTX.N), for $1.3 billion in stock as it looks to save costs and get through the housing downturn.

The deal, which Pulte said would create the largest U.S. homebuilder, calls for the exchange of 0.975 common shares of the company for each share of Centex, valuing the acquisition at $10.50 per share.

The companies said that represented a premium of 32.6 percent over the stock's 20-day average price. The proposed price is also 37.8 percent above Centex's closing price on Tuesday.

Centex shares jumped 28 percent to $9.75 in early New York Stock Exchange trade on Wednesday, while Pulte fell 3.6 percent to $10.38. Moody's placed the ratings of both Pulte and Centex under review for downgrade.

"It's pretty normal consolidation in a very troubled industry," said Gary Shilling, president of investment research firm A. Gary Shilling & Co. "It's exactly what you'd expect. These companies are obviously in big trouble."

Experts predict more strategic stock-for-stock deals this year in distressed sectors, as they help companies reduce costs while allowing shareholders to benefit when conditions improve. With such transactions, companies in struggling industries can bulk up without having to deplete much-needed cash or trying to raise scarce and costly debt financing.

"You have both weakness in sales and write downs on land and existing inventory of houses," Shilling said. "All these things are putting pressure for consolidation in the industry."

At Tuesday's close, the S&P Homebuilders Select Industry Index (.SPHOME) was down nearly 10 percent so far this year.

Pulte, which would take on $1.8 billion of Centex debt, will own about 68 percent of the combined company. It said it would realize annual cost savings of about $350 million from the deal and expects to retire more than $1 billion of debt maturities before the end of this year.

Based on current prices, the combined company would have a market capitalization of $4.1 billion and a presence in more than 59 markets across the United States, Pulte said.

Last year, Pulte and Centex delivered more than 39,000 closings with combined pro forma revenues of $11.6 billion. The combined company would have had more than $3.4 billion of cash as of March 31, 2009.

The deal would allow Pulte to return to profitability more quickly, Chief Executive Richard Dugas said on a conference call.

Dugas expects further consolidation in the industry. The deal would put Pulte and Centex in a stronger position because they acted first, he added.

Dugas will be chairman and CEO of the combined company. The boards of both companies have approved the deal, which is expected to close in the third quarter.

Citigroup (C.N) acted as lead financial adviser to Pulte, with Banc of America Securities (BAC.N), Merrill Lynch and JPMorgan Securities Inc (JPM.N) as financial advisors. Sidley Austin LLP acted as legal adviser.

For Centex, Goldman, Sachs & Co (GS.N) was financial adviser, and Wachtell, Lipton, Rosen & Katz was legal adviser.

Yes, it is, and for a number of reasons. For one thing, housing prices are declining just about nationwide. Plus, mortgage rates are at a serious low. Rates on a 30-year, fixed-rate mortgage are at a level we won't see again in our lifetime. Finally, if you buy before December 1, you'll get an $8,000 tax credit if you're a first-time buyer. For all those reasons, there's really never been a better time to go shopping for real estate.

DECLINING PRICES HAVE HIT SOME AREAS HARDER THAN OTHERS, MEANING YOU MIGHT FIND SOME REAL BARGAINS. WHAT AREAS SHOULD PRESENT THE BEST OPPORTUNITIES?

The areas that have been hardest hit by this housing decline will also provide new buyers with the best opportunities. The cities that saw the steepest declines in housing prices were all in California, Florida, Arizona, Nevada and Michigan. They fell for different reasons. California and Florida were really over-built. They ramped up their building until there was too much supply, not enough demand, and eventually, the market fell apart. Detroit, of course, fell with the collapse of the auto industry. But these declines also represent opportunities if you're looking to buy. The states you'll want to avoid are Utah, Montana, North Dakota, Wyoming and Alaska . They actually saw increases in housing prices, albeit small ones. That's not to say they've escaped the housing crisis. It just means it hasn't hit them yet.

IF YOU BUY NOW, THOUGH, THERE ARE NO GUARANTEES THAT PRICES WON'T KEEP DROPPING. BUT IF YOU'RE LOOKING TO INVEST IN PROPERTY LONG-TERM, YOU SAY CALIFORNIA AND FLORIDA AS GOOD BETS.

We have an aging population here in the U.S. Aging populations look for warm climates, and as the population ages, that will impact on the supply side of housing. There is every reason to think those warmer states will become competitive again. Of course, there are no guarantees.

ARE THERE RULES ALL PROSPECTIVE BUYERS NEED TO LIVE BY TO WIN AT THE REAL ESTATE GAME?

Yes. First, a 20-percent down payment is a must. And you have to have it in your hands: Never borrow that down payment. Next, make sure you go with a fixed-rate mortgage, never a variable-rate one. Also, be aware of what you can afford in terms of mortgage payments; and a good rule of thumb is that an affordable payment is 30 percent of your gross income, or less. Finally, you have to have an emergency fund, in cash, on hand, after you buy. It should equal six months' worth of living expenses. Those are the rules we lived by in the '90s. Then, irresponsible buyers and lenders began to ignore those rules, and the housing mess was created.

FORECLOSURES CONTINUE TO RISE, WITH MORE THAN 74,000 HOMES REPOSSESSED BY MORTGAGE LENDERS IN FEBRUARY ALONE. ARE FORECLOSURE AUCTIONS A GOOD WAY TO GO, IF YOU'RE BUYING REAL ESTATE?

Not necessarily. For one thing, the lien holder generally wins back the homes that are put up for auction. They will nearly always be able to outbid you, and they want the home so they can try to sell it and get back as much of the money they lost in the unpaid mortgage as they possibly can. Also, you have to come to these auctions with the idea that you and the seller are dealing in good faith. They come up so quickly, you usually don't have time to view the house before the sale, so if there are any problems with it, you won't know until you've already paid for it. It would be better to allow the bank to take back the home, and then deal with them, offering something under the asking price, and negotiate.

United States Post Office in the business of real estate

In what can only be described as further misuse of power and money, the United States Post Office has now come under fire. It was reported this past week that the USPS has been involved in the purchasing and selling of homes. This news comes on the heels of the Postmaster General appearing before Congress laying out the case for their financial crisis.

Postmaster General has come before Congress indicating that the service was considering cutting service a day during the week. This move was in response to troubling figures for fiscal year 2010, and the steady decline in the use of postal services.

Republican Senator Chuck Grassley from Iowa, the ranking republican on the Senate Finance Committee, has indicated his disgust with the situation and has insisted that the Post Office Inspector General issue an investigation of the matter. The office has indicated that a report is in the works.

News of this spread when CNN reported that the Post Office purchased a $1.2 million dollar home in South Carolina for the relocation of an employee. It was later revealed that the home belonged to former Postmaster Ronald Hopson. Amid its own financial troubles, CNN reports that the USPS lost an average of $58,000 on a number of homes bought and sold in 2008.

What is more interesting about this situation is what other abuses will be uncovered in the coming weeks, years and months. When did the United States Post Office get into the business of real estate? The American people have for years, entrusted those in business and in government with being good stewards of their tax dollars. As we continue to see, at almost every level, mismanagement of funds have occurred.

In addition, the American people will not be as kind to listen to cuts in service if they are told about the blatant misuse of funds instituted by the USPS; the appearance of such might be outright criminal, the relocation program itself now under fire.

The current Postmaster General and all of the senior level staff over at the USPS should come before Congress again, to testify on these findings. This discovery calls in to question everything mentioned earlier by the USPS and whether or not previous testimony was indeed accurate. Members of Congress and the executive should work out a way to rectify this very important matter; so as to make certain that it does not happen again.

Summary of Guidelines
Making Home Affordable will offer assistance to as many as 7 to 9 million homeowners, making their
mortgages more affordable and helping to prevent the destructive impact of foreclosures on families,
communities and the national economy.
The Home Affordable Refinance program will be available to 4 to 5 million homeowners who have a
solid payment history on an existing mortgage owned by Fannie Mae or Freddie Mac. Normally, these
borrowers would be unable to refinance because their homes have lost value, pushing their current loanto-value ratios above 80%. Under the Home Affordable Refinance program, many of them will now be
eligible to refinance their loan to take advantage of today’s lower mortgage rates or to refinance an
adjustable-rate mortgage into a more stable mortgage, such as a 30-year fixed rate loan.
GSE lenders and servicers already have much of the borrower’s information on file, so documentation
requirements are not likely to be burdensome. In addition, in some cases an appraisal will not be
necessary. This flexibility will make the refinance quicker and less costly for both borrowers and lenders.
The Home Affordable Refinance program ends in June 2010.
The Home Affordable Modification program will help up to 3 to 4 million at-risk homeowners avoid
foreclosure by reducing monthly mortgage payments. Working with the banking and credit union
regulators, the FHA, the VA, the USDA and the Federal Housing Finance Agency, the Treasury
Department today announced program guidelines that are expected to become standard industry practice
in pursuing affordable and sustainable mortgage modifications. This program will work in tandem with
an expanded and improved Hope for Homeowners program.
With the information now available, servicers can begin immediately to modify eligible mortgages
under the Modification program so that at-risk borrowers can better afford their payments. The
detailed guidelines (separate document) provide information on the following:
Eligibility and Verification
•Loans originated on or before January 1, 2009.
•First-lien loans on owner-occupied properties with unpaid principal balance up to $729,750.
Higher limits allowed for owner-occupied properties with 2-4 units.
•All borrowers must fully document income, including signed IRS 4506-T, two most recent pay
stubs, and most recent tax return, and must sign an affidavit of financial hardship.
•Property owner occupancy status will be verified through borrower credit report and other
documentation; no investor-owned, vacant, or condemned properties.
•Incentives to lenders and servicers to modify at risk borrowers who have not yet missed payments
when the servicer determines that the borrower is at imminent risk of default.
•Modifications can start from now until December 31, 2012; loans can be modified only once
under the program.
Loan Modification Terms and Procedures
•Participating servicers are required to service all eligible loans under the rules of the program
unless explicitly prohibited by contract; servicers are required to use reasonable efforts to obtain
waivers of limits on participation.
•Participating loan servicers will be required to use a net present value (NPV) test on each loan
that is at risk of imminent default or at least 60 days delinquent. The NPV test will compare the
net present value of cash flows with modification and without modification. If the test is positive
– meaning that the net present value of expected cash flow is greater in the modification scenario
– the servicer must modify absent fraud or a contract prohibition.
•Parameters of the NPV test are spelled out in the guidelines, including acceptable discount rates,
property valuation methodologies, home price appreciation assumptions, foreclosure costs and
timelines, and borrower cure and redefault rate assumptions.
•Servicers will follow a specified sequence of steps in order to reduce the monthly payment to no
more than 31% of gross monthly income (DTI).
•The modification sequence requires first reducing the interest rate (subject to a rate floor of 2%),
then if necessary extending the term or amortization of the loan up to a maximum of 40 years,
and then if necessary forbearing principal. Principal forgiveness or a Hope for Homeowners
refinancing are acceptable alternatives.
•The monthly payment includes principal, interest, taxes, insurance, flood insurance, homeowner’s
association and/or condominium fees. Monthly income includes wages, salary, overtime, fees,
commissions, tips, social security, pensions, and all other income.
•Servicers must enter into the program agreements with Treasury's financial agent on or
before December 31, 2009.
Payments to Servicers, Lenders, and Responsible Borrowers
•The program will share with the lender/investor the cost of reductions in monthly payments from
38% DTI to 31% DTI.
•Servicers that modify loans according to the guidelines will receive an up-front fee of $1,000 for
each modification, plus “pay for success” fees on still-performing loans of $1,000 per year.
•Homeowners who make their payments on time are eligible for up to $1,000 of principal
reduction payments each year for up to five years.
•The program will provide one-time bonus incentive payments of $1,500 to lender/investors and
$500 to servicers for modifications made while a borrower is still current on mortgage payments.
•The program will include incentives for extinguishing second liens on loans modified under this
program.
•No payments will be made under the program to the lender/investor, servicer, or borrower unless
and until the servicer has first entered into the program agreements with Treasury’s financial
agent.
•Similar incentives will be paid for Hope for Homeowner refinances.
Transparency and Accountability
•Measures to prevent and detect fraud, such as documentation and audit requirements, will be
central to the program.
•Servicers will be required to collect, maintain and transmit records for verification and
compliance review, including borrower eligibility, underwriting, incentive payments, property
verification, and other documentation.
•Freddie Mac will audit compliance.

A first time homebuyer tax credit has been signed into law as part of the Stimulus Package that was created by President Obama. There are many questions as well as many misconceptions that are floating around regarding this legislation. In this month's article I am going to try to clear up some of those questions.

The tax credit in this stimulus plan is for first-time homebuyers only. The Bill had several changes throughout the negotiation process in Congress, some of which included all home buyers. In the final Bill the tax credit applies only to first-time home Buyers. You may ask who qualifies as a first-time homebuyer and the answer is any family unit who has not owned a home as a Principle Residence within the past three years.

The tax credit in the 2009 stimulus package does not have to be repaid. This differs from the first-time home buyer tax credit that was in place in late 2008. In the 2008 plan, the credit was an interest free loan and it had to be repaid within 15 years. In both plans, the home buyer must keep this home as their primary residence for at least 3 years or they may face recapture of the tax credit amount.

In the 2009 tax credit, the amount of credit that you receive is equal to 10% of the purchase price with a maximum credit amount of $8,000. There is a distinct difference between tax credits versus tax deductions. In a tax credit, the credit is a dollar for dollar amount that is paid against the taxes that are owed. A tax deduction is a reduction in the amount of gross income by that amount. Basically, the credit is post tax and the deduction is pretax. A bonus in this year's tax credit is that the credit is refundable. Meaning, if you do not owe taxes larger than the amount of credit that you are receiving, then you will receive a check for the difference.

Another common question is the time frame in which you must purchase a home to qualify for this tax credit. You must purchase a principle residence between January 1, 2009 and December 1, 2009. If you purchased a home in 2008, then you will be subject to the laws which were in place at that time.

Is there a maximum amount of income that you can make to qualify for this tax credit? The answer is yes. If you are a single tax payer and your Modified Adjusted Gross Income is less than $75,000 then you qualify. If you are married and file jointly then the total Modified Adjusted Gross Income must be less than $150,000. There are some provisions for partial tax credit if you make more than the amounts listed above.

Though permit activity dropped sharply last year, Myrtle Beach remains one of the hottest markets in the country, especially when you analyze the number of permits pulled per resident. Only 263,287 people live in the Myrtle Beach metro area, which until recently had been growing its population by nearly 5 percent a year. That means builders pulled one permit for every 82 residents. A steady influx of people, many of them retirees, are drawn by close proximity to the ocean and 117 golf courses at last count. That has helped keep home prices steady; they fell only 10 percent last year to a very affordable $174,800. Most of the home building is split between Brunswick and New Hanover counties. Jobs are dependent on the tourist industry, though, and the metro area was rocked last year when a $400 million rock-and-roll themed amusement part, Hard Rock Park, opened and then filed for bankruptcy. (The Park was SOLD this week and will re-open in May) Myrtle Beach added jobs last year, but as of December employment was decreasing at a 4.2 percent rate compared to a year earlier.

Here's our take on the Stimulis Bill and Treasury announcements made this week. We look at the Stimulis package AND the Treasury's package holistically, in compliment with each other - mostly because that's how the Obama team is looking at it. Your representatives, the NAR Board of Directors, asked us in November to do 4 things (with an unspoken but clearly understood mandate to PRESERVE what we already have). Here they are: 1) get loan limits raised for high cost areas, 2) make the $7,500 tax credit NOT a loan, 3) try to find ways to push interest rates down (which are higher than they should be due to systemic risk right now) by 200 basis points, and 4) help provide solutions to the foreclosure/short sale problem.

So here's what we have achieved: 1) the loan limits will be raised to $727,000 in high cost areas, 2) the tax credit will be raised to $8,000 with NO payback [a true credit], 3) interest rates have come down 125-150 basis points, and 4) the bill has over $50 billion in it for foreclosure mitigation, with Geitners Treasury plan signaling that the second half of TARP and TALF will be used to mitigate foreclosures through a government guarantee, drive down interest rates by buying another $200-300 billion of mortgage paper from the GSES's thereby freeing them up to do the same with new mortgages, and Fannie has just agreed to lift the cap of 4 investment properties eligible for loans and raise it to 10.

In addition, we preserved what we have - which some tend to forget is always on the table when these negotiations start up again - mortgage interest deductability, real estate tax deductability, and the $250,000/$500,000 cap gains exclusion (an overall package worth more than $100 billion and for some a very attractive funding source for their pet projects).

We did make a run at the $15,000 credit -- and we would have loved to have gotten that or the Homebuilders $22,000 credit idea as well as their 5 year loss carryback deal, but they were considered too rich for this program. What it did do though is totally take the debate off of whether a tax credit should be reinstated at all (it expired last year) and whether it was a true credit or a repayable loan, and kept the conversation on how much it should be. It also kept the debate off of 'what we are willing to give up to get a $15,000 tax credit' and kept the debate again, on how much it should be. It's pretty hard to complain when they give you what you ask for and you lose something you never had.
While we study the Treasury specifics on their major role in providing the rest of the housing solution -- there is much more to come and we are working diligently with the Administration to help 'unclog the pipeline' and get capital flowing into housing again.

As rumors and speculation continue to swirl about regarding the stimulus plan, tax credits for first time buyers, and possibly 4.5% 30 year mortgages for the purchase of primary residences, here are some givens regarding seller contributions towards closing costs and pre-paids
1. Conventional & FHA loans allow the seller to pay up to 3%.
2. VA is 4%.
3. USDA rural housing is 3%
4. SC State Housing is 3%
When working out the listing price with your seller, these numbers may help in determining the asking price since the seller contributions are almost a given in the current market.

Existing-home sales jumped 6.5%

Existing-home sales rose unexpectedly while inventory declined, led by a surge of sales in the West, according to the National Association of Realtors®.

Existing-home sales-including single-family, townhomes, condominiums and co-ops-jumped 6.5% to a seasonally adjusted annual rate of 4.74 million units in December from a downwardly revised pace of 4.45 million units in November, but are 3.5% below the 4.91 million-unit pace in December 2007.

For all of 2008 there were 4,912,000 existing-home sales, which was 13.1% below the 5,652,000 transactions recorded in 2007. This is the lowest volume since 1997 when there were 4,371,000 sales.

Lawrence Yun, NAR chief economist, said home prices continue to fall significantly. “It appears some buyers are taking advantage of much lower home prices,” he said. “The higher monthly sales gain and falling inventory are steps in the right direction, but the market is still far from normal balanced conditions. Buyers will continue to have an edge over sellers for the foreseeable future.”

Total housing inventory at the end of December fell 11.7% to 3.68 million existing homes available for sale, which represents a 9.3-month supply at the current sales pace, down from a 11.2-month supply in November.

Yun said the market is underperforming and hurting the broader economy. “We’ve added 25 million people to our population over the past decade and housing affordability conditions are the best we’ve seen since 1973, but household formation is much lower than expected,” he said. “Consequently, there is a pent-up demand which could be unleashed with the right stimulus, including a non-repayable home buyer tax credit. The Obama administration and Congress need to move fast to stimulate a spring sales upturn which will help to stabilize home prices and set the foundation for a sustainable economic recovery.”

The national median existing-home price for all housing types was $175,400 in December, which is 15.3% below December 2007 when the median was $207,000. There remains a significant downward distortion in the current median from a large number of distress sales at discounted prices, currently 45% of transactions; the median is where half of the homes sold for more and half sold for less. For all of 2008, the median price was $198,600, down 9.3% from $219,000 in 2007.

NAR President Charles McMillan, a broker with Coldwell Banker Residential Brokerage in Dallas-Fort Worth, said it’s an excellent time for first-time home buyers with good jobs. “The typical buyer plans to stay in their home for 10 years, which is the correct approach in today’s market,” he said. “With historically low mortgage interest rates, flexible sellers, a large inventory, and homes that are selling for less than replacement construction costs in much of the country, buyers who’ve been on the fence should take a closer look at today’s market.”

McMillan added that first-time buyers may want to consider an FHA loan, which offers downpayments of 3.5% on a safe 30-year fixed-rate mortgage.

According to Freddie Mac, the national average commitment rate for a 30-year, conventional, fixed-rate mortgage fell to 5.29% in December from 6.09% in November; the rate was 6.10% in December 2007. Last week, Freddie Mac reported the 30-year rate was 5.12%.

Single-family home sales rose 7.0% to a seasonally adjusted annual rate of 4.26 million in December from a level of 3.98 million in November, but are 1.4% below a 4.32 million-unit pace in December 2007. For all of 2008, single-family sales fell 11.9% to 4,349,000.

The median existing single-family home price was $174,700 in December, down 14.8% from a year ago. For all of 2008, the single-family median was $197,100, which is 9.5% below 2007.

Existing condominium and co-op sales increased 2.1% to a seasonally adjusted annual rate of 480,000 units in December from 470,000 in November, but are 18.4% below the 588,000-unit level a year ago. For all of 2008, condo sales dropped 21.0% to 563,000 units.

The median existing condo price4 was $181,400 in December, down 18.3% from December 2007. For all of 2008, the median condo price was $210,000, which is 7.2% below 2007.

Regionally, existing-home sales in the Northeast slipped 1.4% to an annual pace of 720,000 in December, and are 14.3% below December 2007. The median price in the Northeast was $235,000, which is 7.8% lower than a year ago.

Existing-home sales in the Midwest increased 4.0% in December to a level of 1.04 million but are 10.3% below a year ago. The median price in the Midwest was $140,800, down 11.4% from December 2007.

In the South, existing-home sales rose 7.4% to an annual pace of 1.74 million in December, but are 11.2% lower than December 2007. The median price in the South was $158,600, which is down 8.0% from a year ago.

Existing-home sales in the West jumped 13.6% to an annual rate of 1.25 million in December and are 31.6% higher than a year ago. The median price in the West was $213,100, down 31.5% from December 2007.

appraisal industry revisions to Home Valuation Code of Conduct

The appraisal industry has justifiably come under fire for its role in the great housing bust. Property appraisals, required by lenders before a loan is made, are supposed to provide an independent assessment of the home's value. But during the boom, appraisers routinely signed off on a doubling or tripling of home values, sometimes racked up in just a matter of months. Investment properties were appraised at prices that made no investment sense. And homeowners were charged a pretty penny for what often amounted to rubber-stamp service.

Now the industry is about to undergo a shakeup. On Jan. 9, Fannie Mae (FNM) and Freddie Mac (FRE) announced revisions to their Home Valuation Code of Conduct. Starting on May 1, lenders that want to sell their loans to the two industry behemoths must follow the new guidelines. Mortgage brokers and Realtors are no longer able to choose appraisers. They will be selected by lenders, which are not allowed to influence appraisers by withholding payments or promising future work. If lenders have in-house appraisers, the bank's loan-origination department is not allowed to influence their valuation decisions or supervise their work.

The changes follow an agreement reached last year between Fannie, Freddie, the New York State Attorney General's Office, which was investigating the appraisal industry, and the Office of Federal Housing Enterprise Oversight, which oversees Fannie and Freddie. The new rules only apply to loans bought by or guaranteed by Fannie and Freddie. Lenders who operate independently of those channels do not have to follow them. But since Fannie and Freddie buy or guarantee a huge share of all U.S. mortgages, the changes should have wide application.

Countrywide Sued over Seattle Appraisal
Typical of the complaints about appraisers' bubble-era behavior are those spelled out in a lawsuit filed on Jan. 12 in the U.S. District Court for the Western District of Washington by Carrol and Gregory Clark. The suit, which seeks class-action status, claims that Countrywide Home Loans and its in-house appraisal arm, LandSafe, inflated home valuations during the boom so Countrywide could make more loans and sell them on Wall Street.

The lawsuit claims that when the Clarks refinanced their Seattle home for $350,000 in February 2007, they were required to use the Countrywide affiliate for the appraisal. It says they paid $410, double what LandSafe actually paid an outside appraiser to do the work. The suit further claims that outside appraisers who didn't come up with high home values were denied future work from the lender.

Countrywide was acquired by Bank of America (BAC) in July 2008. Asked for a response, Bank of America spokeswoman Shirley Norton said, "We have not been served yet, but based on what we have heard about this suit we believe it is without merit."

A lot of appraisers aren't happy about the looming changes. In a poll conducted on Jan. 16 by the American Appraisal Institute trade group, 60% of appraisers said the code was unlikely to change the quality of appraisals. The 600 or so survey participants also said the biggest problem in the industry wasn't pressure from clients, but poorly trained appraisers.

The nation’s foreclosure hemorrhage has finally slowed and 2009 should see a significant decline in foreclosures as buyers return, pushing home prices up and fueling a real estate recovery, according to the 2009 Outlook.

Recovery is underway. Affordable is back in the housing market, say some real estate experts. With 4.5% fixed mortgage rates, housing prices lower than they were 'pre-housing bubble', commodity prices lower, tax credits available for homebuyers, and the government eager to stimulate our economy, for the first time in years I can see prices rising again in 2009.

Third-quarter National Association of Realtor numbers actually show existing home sales picking up in about 20 percent of the areas studied. And, given the uncertainty and volatility of the stock market combined with all time low interest rates, extremely affordable low priced homes, and all the choices out there, 2009 is an excellent time to buy real estate.

South Carolina State Park Schedule I-330

The South Carolina State Park Service hopes you will remember your state parks at tax time. You can do that by designating donations on Schedule I-330 (contributions for check-offs) form in your 2008 South Carolina individual income tax return.

Your contribution will support the natural and cultural beauty that you've come to enjoy over the past 75 years in state parks. Trails that reach deep into the wilderness, programs that teach history and wildlife lessons, and projects that preserve our landscapes and vistas, all can be supported in the check-off program. A few things on the wish list:
Build new wildlife viewing platforms at Huntington Beach State Park. The park is one of the most popular birding destinations on the East Coast.
Create new trails at Upcountry state parks.
Renovate historic cabins at Paris Mountain State Park.
Repaint the historic lighthouse at Hunting Island State Park. The lighthouse has to be painted every few years to protect it from the harsh coastal environment.
South Carolinians contributed more than $33,000 last year using the check-off option. The parks hope to increase that amount in 2009.

The decline in mortgage rates comes after aggressive moves by the Federal Reserve aimed at propping up the U.S. housing market. On Dec. 16, the Federal Open Market Committee lowered a key interest rate, and last month the Fed said it would buy $600 billion in mortgage-related securities and other debt issued by Fannie Mae, Freddie Mac and the Federal Home Loan banks.

The latest rate decline is likely to revive the ailing housing market. According to a survey by the Mortgage Bankers Association earlier this month, refinancings represented almost 77% of all mortgage applications.

But a refinance boomlet is also good news for the broader economy. Millions of homeowners still have costly adjustable-rate mortgages. With access to credit tightening, rates on consumer loans rising and the value of equities falling, the opportunity to lock into a fixed-rate mortgage and to reduce payments could relieve pressure on some household budgets.

On a $200,000 mortgage, for example, a shift from 6.25 to 5.25% interest can save more than $100 per month.

The lower interest rate offers buyers a chance to afford a more expensive home while keep on a budget.

With some local interest rates at 4.75% for a 30 year fixed rate some buyers feel they are seeing the bottom of the real estate market.

penny sales tax beginning January 1st 2009

The Horry County penny sales tax that voters approved in November 2008 will go into effect January 1st 2009.

The sales tax increase will show up on retail purchases beginning January 1st 2009.

The penny tax is to go for the construction of new schools in Horry County without raising property taxes.

80% of the proceeds will go to Horry County Schools, and the the rest will be divided between Horry-Georgetown Technical College and Coastal Carolina University.

Last week, rates hit their lowest point in history, and ended the week about a quarter percent lower than where they began. Although the week ahead will be a short one, there are still several economic indicators scheduled for release that will likely impact rates.
Before we address the week ahead, last week rates hit their lowest point since record keeping began. The big news last week was, of course, the Fed's announcement after their final FOMC meeting of 2008.

In a bold move the Fed decided to drop the Federal Funds Rate (the rate banks charge each other to lend money overnight) to a target of between 0 to .25% and the Discount Rate (the rate at which banks can borrow directly from a Federal Reserve Bank) by .75% to .50%.

Normally, this would have been devastating to mortgage rates and would have likely pushed rates much higher. (Remember, lower rates by the Fed often equate to increased inflation, which is the arch enemy of bonds.) However, in conjunction with the Fed's announcement of decreasing rates to their lowest point ever, the Fed also announced it would be buying as much as $600 Billion of debt issued or guaranteed by Fannie Mae, Freddie Mac and other government-backed mortgage businesses in a direct effort to help lower home loan rates. This news caused bonds to rally to their highest price ever, which in turn pushed rates to their lowest point ever.

The big question is - Will the actions of the Fed last and for how long? One thing is for sure, if your customers qualify for a refinance loan, they may be seeing the lowest rates ever right now.

Federal Reserve announced Tuesday

The Federal Reserve announced Tuesday that it has cut the target for its key federal funds rate to a range of 0 to 0.25 percent, down from 1 percent set back in October.

The federal funds rate is the interest rate banks charge each other. The new target range puts the rate at its lowest level on record.

In the Fed's policy statement, Chairman Bernanke said the committee will use all available tools in order to contain the financial crisis.

The statement also said "weak economic conditions are likely to warrant exceptionally low levels of the federal funds rate for some time."

The outlook for economic activity has weakened further since the Fed's last meeting. Labor markets, consumer spending and business investment all showed declining trends, according to the Fed.

Going forward the Fed will focus on supporting the function of financial markets and aim to stimulate the economy through open market operations.

The Fed said it will continue to purchase large amounts or agency debt and mortgage-backed securities.

The committee also approved a 75 basis point cut in the discount rate to .50 percent.

All changes made by the Fed committee on Tuesday were unanimously approved by the 12 Fed governors.

U.S. markets moved higher on the announcement while yields on 10 year and 30 year Treasury bonds fell.

4.5% mortgage rates

Reporting from Washington -- Could a 4.5% mortgage be your personal piece of the bailout pie?

Apparently many consumers thought precisely that the week after hearing that the Treasury Department was working on plans to slash loan rates for consumers who buy houses in the coming months.

The news threw a wrench into the marketplace -- making some shoppers reluctant to commit to purchase without guaranteed access to 4.5% mortgage money. In some cases, it stalled deals that were ready to go.

"It put us into limbo," said Dennis Badagliacco, chief executive of Altera Real Estate, a brokerage firm in San Jose. "Once [news] leaked out, it immediately slowed down" the pace of sales contracts and discussions, he said -- an ironic side effect of a plan ultimately meant to stimulate real estate transactions.

Customers didn't want to gamble that they'd be locked into a 5.5% mortgage when 4.5% financing might be readily available if they simply waited a week or two, Badagliacco said.

Another irony of the situation: The National Assn. of Realtors, of which Badagliacco is a director, was the primary force behind the concept of federal intervention to lower rates by a full percentage point. Representatives of the association brought the proposal to federal officials as part of a multipoint plan to kick-start the economy through housing.

The Federal Reserve has already formally adopted one of the group's recommendations -- committing to buy $500 billion in mortgage securities to inject liquidity into a market burdened by investors' fears, and to buy $100 billion in debt issued by Fannie Mae and Freddie Mac. Those moves knocked 30-year mortgage rates down by half a percentage point within a day, from 6% to 5.5%.

But setting up a program in which the government would buy securities backed by loans originated by private lenders at 4.5% would take longer to implement.

So what do you do if you're already well along in your shopping, you've found a house at a great price and you're ready to apply for a mortgage at 5.5%, but don't want to miss out on potentially lower rates?

Ask your broker or loan officer whether you can lock in today's rate but still have the ability to move down should cheaper money become available. Not all lenders can accommodate such requests, but some brokers offer 60-day locks with that option. Others may charge you.

Either way, you're better prepared for your own little bailout -- just in case it comes your way -- without having to risk losing the house you really want.

Loan modifications

a private investor in mortgage-backed securities, filed a lawsuit in New York State Supreme Court on December 1st alleging that the proposed modification of some 400,000 home loans originally underwritten by the defunct lender Countrywide Financial is illegal.

The lawsuit, which seeks class-action status, was filed against Bank of America, which bought Countrywide in late 2007. Frey argues that most of the Countrywide loans are not Countrywide's or Bank of America's to modify, but rather are owned by trusts that bought them through securitization.

In an article published by BusinessWeek.com, Frey claims that BofA’s modifications will short bondholders $8.4 billion by reducing borrower payments. While those loan adjustments may help to keep struggling borrowers in their homes today, Frey says those alterations run the risk of permanently damaging the secondary market for housing finance.

At the heart of the issue is how loans are packaged and securitized. Typically once a loan is originated it is packaged and sold off to investors. These securities are called Mortgage Backed Securities or MBSs. These MBSs are purchased by trusts put together by Wall Street bankers. When borrowers pay interest and principal on their mortgage loans, those payments go to the trusts, not to the lender that initially made the mortgage loans. To raise the money to buy or fund the loans, the trusts sell interests in a pool to investors or bondholders. Therefore, when banks modify the terms or principle amount of the loans held by the trusts it is the trust not the bank that takes the loss.

"I am an advocate for investors' contractual rights," says Frey, 50, in the interview. He has publicly argued since March that loan modifications are against contract law, and has threatened to sue banks -- despite, he says, receiving pressure to back down from Washington.

"Investors' voices have been muted in this debate because they speak of an inconvenient truth: Current solutions sacrifice the long-term viability of this nation's housing finance system for short-term political gain. No matter how noble the intent, it is not in the interest of the United States now, or in the future, to tell its citizens and the world at large that U.S. contract rights may be bent with the political winds," added Frey.

While so far Frey is the only member of the proposed class against BofA, Frey says he's on a crusade on behalf of all large investors who bought Triple A-rated mortgage bonds, and not just those who bought bonds backed by Countrywide mortgages. The suit alleges that modifications favor bondholders who bought the riskiest pieces. Normally those investors should suffer losses first, but that's not what's happening in the current wave of workouts, according to the suit.

In another published report, BofA spokeswoman Shirley Norton says: "We have not yet received a filing and, therefore, we cannot comment on specific claims. We are, however, disappointed in this attempt to halt a program intended to keep as many as 400,000 at-risk families in their homes and, together with similar programs across the industry, stabilize the nation's housing market. We are confident that together with the attorneys general we have built a program that benefits both consumers and investors, whose interests we carefully considered in developing our program."

Frey suggests that a solution would be for the government to buy all the troubled loans from mortgage-backed securities pools at a price tag of roughly another $500 billion. Under Frey’s plan bondholders would be made whole and the government -- that is taxpayers -- would then have their investment reduced when loans are modified.

If successful, the suit may put a halt to modification of loans without getting permission from the trusts who ultimately own the loans.
